In compliance with current legislation, Midimal (hereinafter also referred to as the Website) undertakes to adopt the necessary technical and organizational measures, according to the level of security appropriate to the risk of the data collected.

This privacy policy complies with current Spanish and European regulations regarding the protection of personal data online. Specifically, it complies with the following standards:

Personal Data Registry

The personal data collected by Midimal, through the forms on its pages, will be entered into an automated file under the responsibility of the Data Controller, and duly declared and registered in the General Registry of the Data Protection Agency, which can be consulted on the website of the Spanish Data Protection Agency (http://www.agpd.es), in order to facilitate, expedite and fulfill the commitments established between Midimal and the User or the maintenance of the relationship established in the forms that the User completes, or to respond to a request or query from the User.

Principles applicable to the processing of personal data

The processing of the User's personal data will be subject to the following principles set out in Article 5 of the GDPR and Article 4 et seq. of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights:

  • Principle of legality, loyalty, and transparency: the User's consent will always be required after fully transparent information about the purposes for which personal data is collected.
  • Principle of purpose limitation: personal data will be collected for specific, explicit, and legitimate purposes.
  • Data minimization principle: the personal data collected will be only those strictly necessary in relation to the purposes for which they are processed.
  • Principle of accuracy: Personal data must be accurate and always up to date.
  • Principle of limitation of retention period: Personal data will only be kept in a form that allows the identification of the User for the time necessary for the purposes of its processing.
  • Principle of integrity and confidentiality: Personal data will be treated in a manner that guarantees its security and confidentiality.
  • Principle of proactive accountability: The Data Controller shall be responsible for ensuring that the above principles are met.

Categories of personal data

The categories of data processed by Midimal are solely identifying data. Under no circumstances are special categories of personal data processed within the meaning of Article 9 of the GDPR.

Legal basis for the processing of personal data

The legal basis for the processing of personal data is consent. Midimal undertakes to obtain the User's express and verifiable consent for the processing of their personal data for one or more specific purposes.

The User has the right to withdraw their consent at any time. Withdrawing consent is as easy as giving it. As a general rule, withdrawing consent will not affect use of the Website.

Whenever the User must or may provide their data through forms to make inquiries, request information, or for reasons related to the content of the Website, they will be informed if completion of any of these forms is mandatory because they are essential for the proper development of the transaction.

Purposes of the processing to which the personal data are destined

Personal data is collected and managed by Midimal for the purpose of facilitating, streamlining, and fulfilling the commitments established between the Website and the User, or maintaining the relationship established in the forms the User completes, or to respond to a request or query.

If the Data Controller intends to transfer personal data to a third country or international organization, at the time the personal data is obtained, the User will be informed of the third country or international organization to which the data is intended to be transferred, as well as of the existence or absence of an adequacy decision by the Commission.

Personal data of minors

In compliance with Articles 8 of the GDPR and 7 of Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights, only those over 14 years of age may give their consent for Midimal to lawfully process their personal data. If the person is under 14 years of age, the consent of their parents or guardians will be required for processing, and this will only be considered lawful to the extent that they have authorized it.

Secrecy and security of personal data

Midimal undertakes to adopt the necessary technical and organizational measures, according to the level of security appropriate to the risk of the data collected, in order to guarantee the security of personal data and prevent the accidental or unlawful destruction, loss, alteration, or unauthorized communication of or access to personal data transmitted, stored, or otherwise processed.

The Website has an SSL (Secure Socket Layer) certificate, which ensures that personal data is transmitted securely and confidentially, as data transmission between the server and the User, and in feedback, is fully encrypted.

However, since Midimal cannot guarantee the impregnability of the Internet or the total absence of hackers or others who fraudulently access personal data, the Data Controller undertakes to notify the User without undue delay in the event of a personal data breach that is likely to entail a high risk to the rights and freedoms of natural persons. Pursuant to Article 4 of the GDPR, a personal data breach is understood to mean any breach of security leading to the accidental or unlawful destruction, loss, alteration, or unauthorized disclosure of or access to personal data transmitted, stored, or otherwise processed.

Personal data will be treated as confidential by the Data Controller, who undertakes to inform and guarantee, through a legal or contractual obligation, that such confidentiality is respected by its employees, partners, and any person to whom the information is made accessible.

Rights arising from the processing of personal data

The User has the following rights over Midimal and may therefore exercise them against the Data Controller, as recognized in the GDPR and in Organic Law 3/2018, of December 5, on the Protection of Personal Data and the Guarantee of Digital Rights:

  • Right of access : This is the User's right to obtain confirmation as to whether or not Midimal is processing their personal data and, if so, to obtain information about their specific personal data and the processing that Midimal has carried out or is carrying out, as well as, among other things, information available about the origin of said data and the recipients of any communications made or planned for them.
  • Right to rectification : This is the User's right to have their personal data modified if it is inaccurate or, taking into account the purposes of the processing, incomplete.
  • Right to erasure ("the right to be forgotten") : This is the User's right, unless otherwise provided by current legislation, to obtain the erasure of their personal data when they are no longer necessary for the purposes for which they were collected or processed; the User has withdrawn their consent to the processing and there is no other legal basis for this; the User objects to the processing and there is no other legitimate reason to continue with it; the personal data have been processed unlawfully; the personal data must be erased in compliance with a legal obligation; or the personal data have been obtained as a result of a direct offer of information society services to a child under 14 years of age. In addition to erasing the data, the Data Controller, taking into account available technology and the cost of its implementation, must take reasonable measures to inform the controllers processing the personal data of the interested party's request to erase any links to those personal data.
  • Right to restriction of processing : This is the User's right to restrict the processing of their personal data. Whenever technically feasible, the Data Controller shall transmit the data directly to that other controller.

  • Right not to be subject to a decision based solely on automated processing , including profiling : This is the User's right not to be subject to an individualized decision based solely on automated processing of their personal data, including profiling, unless otherwise provided by current legislation.

In cases where representation is permitted, identification by the same means will also be required for the person representing the User, as well as the document proving the representation.
